We only have eight staff. Do we need HR support?
Most of the employment claims we defend come from businesses of that size, precisely because there was nobody whose job it was to follow the process. The support scales to what you need.
We prepare you for it, script it where that helps, and can attend as a note-taker. The conversation itself is normally better held by the manager who owns the relationship.
Carefully. There are potential disability discrimination issues alongside the capability question, and medical evidence is usually needed before any decision. Take advice before starting the process.
Deal with it within the statutory timetable and only refuse on one of the permitted grounds, with reasons. The process is more prescriptive than most employers expect.
